New Rules for Australian Partner Visas from Late 2021

Alan Tudge, Acting Immigration Minister, revealed new details of the English language requirements for the partner visa, which pointed out that migrants and their permanent resident sponsors would be required to have functional-level English or they would be able to demonstrate that they would complete the 500 hours of free English language classes through the Adult Migration English Program (AMEP) from the middle of this year.

 

Moreover, there is a change in the partner sponsorship online application form which declares that they have read and understand the information about reducing violence in the community and they consent to the Department disclosing convictions to the applicants.

 

Many migrants worry that their visa would be cancelled if they break up with their partner, thus they tolerate family violence. However, family violence is not acceptable in Australia. If you separate from your partner because of family violence, you will not lose your visa. In addition, you should notify the Department if you are suffering from family violence.

 

Family and domestic violence can include:

• physical violence, such as: punching, hitting, kicking, pushing, choking

• sexual assault

• verbal or emotional abuse

• controlling behaviour

• stalking

• technology facilitated abuse

• financial abuse

• abuse of the elderly

• forced isolation or economic deprivation, including dowry-related abuse
